Should Supreme Court Justice Scalia step down because he is no longer serving the people?

Last week In the oral arguments before the Supreme Court to determine whether a key section of the Voting Rights Act should be upheld Judge Scalia called the vital protection for citizens Constitutional rights a "perpetuation of racial entitlement."  

Now it is hard to believe Scalia is not aware of the laws or the history of this country to say that the law gives racial entitlement to blacks or say, that the courts don't have jurisdiction over state's rights.

Fifteenth Amendment to the United States Constitution:

        Section 1. The right of citizens of the United States to vote shall not be denied or abridged by the United States or by any State on account of race, color, or previous condition of servitude(slaves).

        Section 2. The Congress shall have power to enforce this article by appropriate legislation

First The law was ordinarily given due to certain states and counties with a record of racial discrimination against blacks
From 1890 to now,  Southern states actively adopted poll taxes to disenfranchise black Americans.
Because black Americans comprised as much as 40 percent of the population or more in many Southern states,their votes were very significant and racist Southern leaders did not want those citizens to have the power of the vote, In the 1950s they claimed that black voters had been largely responsible for the reconstruction government and something had to be done to stop it from happen again,
They had crazy questions for the non-whites only, questions that whites couldn't answer
 like how many bubbles in a bar of soap? what ever answer given you'll two bubbles short, so to keep the democratic process honest and open so that whites wasn't given privilege treatment while discriminating against the black citizens the law was created. That is why now the states needs to receive permission from the U.S. Department of Justice (DOJ) before they can change their election laws. The law is doing the opposite of the what Scalia said.

On the statement "This is not the kind of a question you can leave to Congress"

Does he not know about the recent gerrymandering actions that occurred across the country right before the 2012 presidential election?

The law works. I think Scalis is an intelligent man and understands  right from wrong , here he is either a "troll"  someone that might not believe what they say but they say it to get opposing viewers mad or he is a true racist and hates others races having equal rights.

District of Columbia v. Heller, 554 U.S. 570 (2008), was a landmark case in which the Supreme Court of the United States held that the Second Amendment to the United States Constitution protects an individual's right to possess a firearm for traditionally lawful purposes, such as self-defense within the home and within federal enclaves. The decision did not address the question of whether the Second Amendment extends beyond federal enclaves to the states,[1] which was addressed later by McDonald v. Chicago (2010). It was the first Supreme Court case in United States history to decide whether the Second Amendment protects an individual right to keep and bear arms for self-defense.[2]

IN both of these cases, the SCOTUS ruled in favor of the right to bear arms.

This little tidbit shouldn't be overlooked by the rabid anti-gunners.  Shame on pat88 for trying to play "label the racist".  Shame.

That's correct Herb.  pat88 decided to post something about a Supreme Court Justice............and we are pointing out the hypocrisy of the post.

The whole idea is to discredit Justice Scalia, and the driving force behind it is not racism, it's the fact that he's a staunch supporter of the 2nd amendment.

Pat88 -- Justice Scalia isn't necessarily racist, he's going senile.  He's been a SC Justice too long.

My view of this is Republican strategists and big money are still looking to short circuit voting rights for people of color, minorities and Democrats.  Wisconsin, Pennsylvania and other states could be added to the list of states has are mandated to ask permission of the DOJ to make any changes to their voting laws.

The United States is no longer in danger of becoming an oligarchy, the United States IS an oligarchy

Pay no attention to that group of gun nuts in the corner.  All they every want to do is talk about guns.  Therefore, a discussion of a case before the Supreme Court last week about VOTING RIGHTS gets turned into gun law.

C'mon!

Even uber-liberal Bill Maher admitted last Friday that Scalia has a history of saying things just to be inflammatory.

But let's at least get this part of it straight....Scalia was talking about the Voting Rights Act of 1965.....not the 15th Amendment (as the OP makes it appear).

And if Scalia's stupid remarks about Congressional legislation is enough to force him to step down...then since the others feel that they have a right to legislate the Bill of Rights out of existence (specifically the 2nd Amendment)....then they should be forced to step down too.

A good comparison would be "Tyrone".  He admits to being 75 and consider his postings.  They are inflammatory and belittling.  He sounds just like Scalia but without the education.

And they are looking at the fact that by requiring racial gerrymandering....the possibility that that particular provision violates the 10th, 14th, and 15th Amendments.

Drawing district lines specifically to elect minorities into Congress is just as wrong as drawing the lines to keep them out. Or just as wrong as rigging districts for one particular political party.
